OK this is quite important: Penguin 1.0 is now gone and Penguin 2.0 data replaces 1.0. So you're site is now free of Penguin 1.0 but probably caught by Penguin 2.0.
Nothing to say that Disavow makes any difference.

I hope the next update goes in my favour, penguin 2 really stuffed me and my site seo isnt spammy at all
Sites that are less relevant and spammy outrank me
